Texas Real EstateAnything you plan to take with you to your new home must be clearly stated or arranged for before you show the house for the first time. Buyers can legally assume that anything attached to the house goes with it.

North Richland Hills TX – Sell Your House Fast:  Selling a house means that you will no longer live there, of course. Your personal effects will go with you to your new home. There is a line to be drawn where a legal home sale is conducted and it pays to know what will be expected by the buyer. You can then prepare your move and know how to take what you believe is yours.

Affixed property is part of the real estate deal. If you love your chandelier that hangs over your dining area and assume that you will take it to your new house, be sure to stipulate that in the sale contract. Even better, take it down before you show the house and replace it with something else. This is the law in most places and it won’t matter that the chandelier came from Germany on the boat with your 1st generation American relatives to reach Ellis Island. The law will most likely side with the buyer if the lamp is affixed to the property and was not excluded from the contract when they agreed to buy the house.

It’s very easy to overlook things such as these when you have lived in a home for many years. We tend to take those things around us for granted. The best defense against losing something so special or necessary to your family is to go around the house, from room to room, and carefully assess what is in there. Perhaps there is a hand painted light switch cover that your son painted for you when he was in kindergarten 20 years ago. Surely you will take that along, but not if it wasn’t removed before you showed the house, or made it clear in the contract.

Have you built a potting shed in the yard that you assume you will take to the new house? You can take it if it isn’t cemented or otherwise fastened into the ground. You will need to state very clearly in the showing of the house, and follow it up in writing when you make up the contract. Believe it or not, home sales have been lost over such small items as a washing machine or a pair of stained glass hanging window coverings because the buyer somehow feels cheated or deceived. Though it may seem like a small detail to you, the buyer may lose trust in you and call it off.
